Tract 3961 CC&R set-back amendment fails

After two attempts to meet the required minimum number of votes to reach quorum, Tract 3961’s special meeting successfully took place last week with the measure it was voting on failing.

The CC&R Amendment Tract 3961 members were voting on was whether to change the 20-foot setback restriction of trailer parking on driveways to five feet from the curb. To pass the amendment, two thirds of the total 122 members of Tract 3961 would need to vote in favor (82 votes).

The Canyon Lake POA received 78 ballots from the total possible 122 members in Tract 3961. With 55 votes in favor and 23 votes against, the amendment failed by 27 votes.

The original election date was June 8, however, the quorum was not met, so an adjourned meeting was required to be scheduled in August. But, that meeting also did not meet the quorum of 25 percent of the total members in Tract 3961.

After the Adjourned Special Meeting of the Tract 3961 members in August didn’t meet quorum, the Canyon Lake POA adjourned the meeting again until Nov. 2 in a last-ditch attempt to collect the number of votes needed.

A raffle was held by the POA to encourage those in this tract to vote. All who voted were entered into a raffle for one of two $100 Canyon Lake POA Gift Cards.

“There was a raffle to encourage voting and two lucky members who voted have been selected and will be contacted by our Corporate department,” Tiffany Cribbs, CLPOA Senior Communications Specialist, said.
