Lake Lease Litigation Agreement Completed

The Canyon Lake POA has executed a settlement with EVMWD, in the pending litigation in Riverside Superior Court (Case No. RIC 1503428).

The settlement is contingent on the Court granting class certification, for settlement purposes only, of all “Lakefront Owners” as defined in the settlement agreement. Below is a summary of the major points of the settlement:

The Settlement will be effective after 10 days from the date the Court grants final approval of class certification and class settlement, provided neither CLPOA nor EVMWD exercise an option to cancel the Settlement within that time.

As of the effective date of the Settlement, EVMWD will approve all Shoreline Improvements existing as of March 26, 2019, regardless whether EVMWD believes such Shoreline Improvements are permissible under the Lake Lease.

Going forward, Shoreline Owners will need approval from both CLPOA and EVMWD to make any “Material Change or Construction of New Shoreline Improvement,” (as that term is defined in the Settlement) and to execute a “License Agreement” (the form of which is attached to the Settlement) to be recorded against the requesting Shoreline Owner’s property, as originally intended by the Lake Lease.

CLPOA and EVMWD agree to dismiss all claims against each other in this action, pursuant to a mutual release and waiver of CC § 1542.

CLPOA and EVMWD to bear their own costs relative to this action.

CLPOA and EVMWD agree the boundary of the real property leased by CLPOA pursuant to the Lake Lease is as described in the survey, incorporated into the Settlement Agreement as Attachment 2.

After judgment is entered in this matter, an abstract of judgment will be recorded against all Lakefront Lots. CLPOA and EVMWD will equally share the costs of recording such abstracts of judgment, so future purchasers have constructive notice of the Shoreline Improvements that have been approved by EVMWD pursuant to the Settlement, as well as the required process for future Shoreline Improvements.

Free Junior Tennis Clinics

A new introductory junior tennis clinic designed to teach children the sport of tennis takes place Wednesday for children ages 6 to 16.  Canyon Lake children are invited to participate in the free clinic where the emphasis will be on enjoyment and learning basic strokes.

Clinics will be taught by Tennis Pro Brien Sullivan and will take place every Wednesday at 3:00 p.m. on Courts 1 and 2. No reservations are required, so participants just need to show up.

L.A. Guns Concert set for April

1980s metal sensation, L.A. Guns, will perform at the Canyon Lake POA’s next Concerts at the Lodge series on April 25. Tickets are now on sale.

L.A. Guns was formed in 1983 by guitar player Tracii Guns and, then unknown singer, Axl Rose on lead vocals. The team of Guns and, former Girl singer, Phil Lewis have sold 6.5 million records. Albums included 1988’s L.A. Guns and 1990’s Cocked and Loaded, both of which were certified Gold. The current lineup features founding member, and lead guitar player, Guns, who has reunited with Lewis on vocals, along with Shane Fitzgibbon on drums, Johnny Martin on bass and Ace Von Johnson on guitar.

Debby Gagnon named Fiesta Day Grand Marshal

The Fiesta Day Committee is proud to present the Grand Marshal title to Debby Gagnon, the long-time owner of Pack, Wrap and Post in the Town Center.

“Part of why I fell in love with Canyon Lake is because we are Small Town USA,” Debby said. “You can get involved in this community and, if you want to put in the time, you can make a difference.”

And that is what Debby has done – as a resident, as a business owner and as an organizer of numerous community events. She has lived in Canyon Lake since 1986.

At least twice she has been named “Volunteer of the Year” (2009 and 2012) by the Canyon Lake Chamber of Commerce.
