POA reaches partial settlement in litigation

Attorneys for the POA have been litigating claims against the engineer, contractors and material suppliers for the premature failure of pavement throughout the community from the paving project completed in 2012/2013.

The POA recently settled with the paving project’s general contractor Hardy & Harper, Inc., and project engineer Albert A. Webb Associates, totaling $5,500,000.

A settlement has not been reached with the project’s asphalt suppliers R.J. Noble Company, Inc. and All American Asphalt.

The POA will continue to proceed in the litigation against the two remaining parties.

On Nov. 20, a Case Management Conference was held at the Riverside Superior Court during which time the presiding judge set a May 15, 2020, trial date for the case. The judge also ordered the parties to conduct a final mediation in late March 2020 to attempt to reach a global resolution of the outstanding claims before the May 2020 trial.

In the coming months, the parties will engage in expert witness and percipient witness depositions to complete the remaining discovery and begin final preparations in advance of the May 2020 trial.
