RELEASE AND WAIVER OF LIABILITY
The undersigned, being the parent(s) and/or legal guardian(s) of ______________________________, a minor, do hereby agree, understand and consent as follows: In consideration of the above referenced minor being permitted to participate in The Kids Fishing Derby, the undersigned hereby releases, waives, discharges and covenants on behalf of the minor identified above not to sue Canyon Lake Bassmasters or any of their directors, officers or members (hereinafter referred to as ‘releases’) from all liability to the un- dersigned on behalf of the minor identified above for any loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the minor identified above whether caused by the negli- gence of the releases or otherwise while the minor identified above is engaged in The Kids Fishing Derby. The undersigned hereby assumes on behalf of the minor identified above full responsibility for and risk of bodily injury, death, property damage due to the negligence of releases or otherwise while engaged in The Kids Fishing Derby.
The undersigned on behalf of the minor identified above further expressly agrees that the foregoing release and waiver agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. The undersigned has read and voluntarily signs the release and waiver of liability and further agrees that no oral representations, statements or inducement apart from the foregoing written agreement have been made.

the Senior Center/motorcycle parking lot would not be able to turn left out of the parking lot back into the community.
Following that meeting, the guard- houses’ layout changed along with the location of the gate arms. The updated design plan was presented at the De- cember 2, 2014 Regular Session Board Meeting.
Upon additional community input, the final design plan was modified to exclude the pre-gate (“arch”). The As- sociation says, with the new configu- ration, guards will have the ability to turn vehicles around before they enter the community through the gate. Also, drivers exiting the Senior Center will be able to turn in either direction, and Golden Gate will remain open for those who want to turn right onto Canyon Lake Dr. South.
The new entrance will have three lanes. The right lane will be an RFID lane with an automatic gate which only opens for vehicles with an RFID decal. The left lane will be the visitor (guest) lane with a gate guard who can issue new guest passes. The middle lane will be a catch-all lane that will include a card swipe machine for members to swipe their POA Card.
Many have asked why the Board did not put the Main Gate Project to a vote of the members. As indicated above, the Directors believe they have brought the project in under $800,000 so a vote of the people is not required.
Plus, as Director Bruce Yarbrough pointed out at the August 4 meeting, there is a long history of Boards voting for projects without having to take them to a vote of the members. It’s their job as Directors to make those decisions on behalf of the community, he says. He notes that the Board has received letters and emails in support of improving the Main Gate.
He further explained that most people don’t want to spend money, so it’s like- ly that members would vote down the Main Gate Project as well as other im- provements that the Board, after a great deal of research, believes are in the best interest of the community.
Director Eric Spitzer, who was the only one to vote against all of the Main Gate components except security cam- eras, requested at the August 4 meeting that the Main Gate Project be put on the ballot in the upcoming recall election; that got big applause from the audience. However, according to Davis-Stirling. com, “The only business that may be conducted at the special meeting is the recall of the directors and the election of new directors in the event the recall is successful.”
