Quorum not yet met, POA urges members to vote
One-third of the voting power must return their ballots or be present at An- nual and Special Meeting of the Mem- bers in order for the meeting to be held. The total number of ballots needed to meet quorum is 1,535. The total number of ballots received at the time of print is 1,101; 434 votes are still needed to meet quorum.
The POA urges members to turn in their ballots even if they don’t want to vote. If quorum is not met on May 11, it may result in an adjournment, which will cost the Association money. Mem- bers who do not wish to vote should mark their ballots “quorum purposes only.”
Three of the five seats on the board
are up for election. The two year terms of Bruce Yarbrough, Eric Spitzer and Ed- ward “Ted” Horton will expire on May 11. The candidates for the 2017/2019 Board of Directors are Tom Nathan, Phil Hawgood, Paul Chenette and Michael Harris. Their resumes can be viewed on the POA website at canyonlakepoa.com.
The Canyon Lake Property Own- ers Association notice of Annual and Special Meeting of the Members will be held on Thursday, May 11, at 9 a.m. in the Holiday Bay Room at the lodge. Members should bring their POA ID card.
The purpose of the membership meeting is for the members to elect three directors for the POA Board of Direc-
tors for a two year term each, provide response to an advisory vote regarding amending the CC&Rs on fence restric- tion and to provide response to an ad- visory vote regarding amending the CC&Rs on three-wheeled, energy effi- cient, motorized vehicles.
Ballots were mailed to members on April 11. Only primary members may vote. Monday, May 8 is the last day to recommend a homeowner mail a ballot.
Mailed and hand delivered ballots to HOA Elections’ office must be received no later than Wednesday, May 10 at 5:00 p.m.
Ballots may be submitted at the mem- bership meeting at the lodge on May 11 between the hours of 8 and 9 a.m. Bal-
lots must be delivered no later than 9 a.m.
Proxies are no longer allowed; how- ever, cumulative voting is permitted. This means voters may cast all votes for one candidate or distribute the votes among the candidates. Fractional voting is prohibited.

Advisory votes will be used to gauge member interest
The advisory votes pertaining to the fence restriction and three-wheeled mo- torized vehicles do not constitute a for- mal vote to amend the CC&Rs and are not binding on the Board of Directors. The advisory vote will be used as a sur- vey to help gauge interest in future pro- posed amendments.
Board members say the fence restric-
tion is an important issue because it’s one of the items most often brought be- fore the Architectural Control Commit- tee and Appeals Committee. These com- mittees have received many requests for taller fences over the years, but due to the current CC&R restriction, they have not been able to approve these requests.
The current fence height limit is re-
stricted to five feet. The Board of Direc- tors say two of the reasons often given for wanting taller fences is greater pri- vacy and/or the fact that many of the standard fence heights for new pre-fab- ricated fences is six feet.
Board members, staff and residents themselves have fought for a fence height amendment over the years. The
amendment was placed on the ballot in 2007, 2008 and 2009. A majority of the voters have shown in the past that they wanted the amendment to pass. Howev- er; it never passed because not enough voters voted. It’s now in the hands of prime members who are willing to pick up their ballot and cast their vote.
