Vote to Recall: Dave Eilers, Doug Gordon & Bruce Yarbrough REASONS for RECALL:
1. They have violated their Fiduciary Duties to the membership multiple times over the last two years. 2. They continue to violate our Governing Documents with no regard for the law.
3. They crafted new rules for members that were not previously approved by the Board or the Membership for the sole purpose of taking away their rights as members.
4. They insist on proceeding with the main gate redesign at a cost of over $1 Million in light of overwhelming opposition to this needless project.
5. They orchestrated a new revision of by-laws that failed in the election that would have disenfranchised more than 1,000 property owners. The proposed by-laws, had they passed, would have significantly changed property rights or rights of Members in an association without a legitimate newly created or recognized need.
6. They prohibited CLPOA members from attending POA board meetings in direction violation of the Davis-Stirling Act, by-laws, Corporations Code and the California Constitution.
7. They violated the $800,000 rule in our by-laws that prohibits the Board of Directors from spending more than $800,000 on any one amenity in a two-year period.
8. Former POA President Dave Eilers referred to a member as a “Fat Bitch” and a “Disgusting Pig” at the August 4, 2015 POA Meeting. See: www.youtube.com/watch?v=H_cTgKE-XOc
9. We can no longer afford the security detail for Eilers. They have spent hundreds of thousands of dollars on extra security at POA meetings and events. Why?
10. They refused to supply the General Manager’s lucrative contract, which we were entitled to as Members. They were taken to both small claims and superior court and they lost. The contract is now public knowledge.
11. They refused to supply a copy of the Golf Pro’s financials to a Member. Furthermore, the Controller was not aware of any requirement to supply the financials despite the fact that this is a part of the contract between CLPOA and the Golf Pro.
12. They spent over 1.6 million on the golf course for a drought tolerant project illegally. Now the Association will have to have to pay more than $200,000 to remove the 18 acres of weeds.
